THIS PAGE CONTAINS THE STANDARD TERMS AND CONDITIONS OF SALES BETWEEN BUYER AND LAUNCH 3 TELECOM RELATED TO PRODUCTS, MATERIALS, AND EQUIPMENT.
Products shall be quoted by Launch 3 Telecom to Buyer. All prices and discounts are subject to change without advance notice for thirty (30) days from the date of the quotation. Prices stated do not include any sales, use, or excise tax or any other tax, duty or charge which is now in effect or may be hereafter imposed by any Federal, State, or other authority. All such taxes, duties or other charges shall be paid by Buyer unless Buyer shall provide Seller an exemption certificate acceptable to the appropriate authorities.
Buyer will provide Seller with valid and updated credit card information, or with a valid purchase order or alternative document reasonably acceptable to Seller. If Buyer provides credit card information to Seller, Buyer authorizes Seller to charge such credit card for all purchased services and products listed in the order form. If the order form specifies that payment will be by a method other than a credit card, Seller will invoice you in advance and otherwise in accordance with the relevant order form. In addition, Buyer shall be responsible for all fees and expenses incurred by Seller in collecting any payments due hereunder, including, but not limited to, attorneys’ fees and collection costs. Credit limits shall be determined and modified at the sole discretion of Launch 3 Telecom. If a customer is delinquent in payment, Launch 3 Telecom may suspend any shipment or delivery or refuse to perform any work until all past due amounts, including finance charges, have been paid in full.
Launch 3 uses a variety of different shipping methods which includes the best shipping rates for our customers. We reserve the right to choose the freight carrier unless otherwise specified by you, the customer. Shipping costs will be added to your order once carrier and point of delivery has been determined. Shipping schedules are estimates only which cannot be guaranteed because of the nature of Launch 3 Telecom’s products, and material, labor, and manufacturing conditions beyond Launch 3 Telecom’s reasonable control. Under no circumstances shall Launch 3 Telecom be responsible for any inability or delay in meeting shipping schedules or for any loss or damage (whether direct or consequential) resulting therefrom.
DAMAGES IN TRANSIT/CLAIMS
All shipments must be thoroughly inspected for visible damage and completeness by the recipient before accepting delivery from the carrier. Any claims for concealed damage or material shortages must be promptly reported to us within 24 hours of the receipt.
All requests to return merchandise must be made within 30 days from the date of purchase. No products are to be returned to Seller without prior approval from Seller. Credit or replacement will only be made after a thorough inspection of the products has been made by Seller’s representative and investigation shows that it is defective or was shipped in error. A return authorization will be given to Buyer by Seller’s sales representative for returnable merchandise and must accompany the shipment. Seller retains the right to apply a 25% restocking charge on returns.
Use of the service is at sole risk by buyer. Service provided by Supplier is on an “as is” and “as available” basis. Seller explicitly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, suitability for a particular purpose and non-breach.
Seller makes no warranty that:
- The service will meet your requirements, the service will be uninterrupted, timely, secure, or error-free,
- The results attained from the use of the service will be precise or dependable,
- The quality of any products, services, information, or other material purchased or acquired by the buyer through the service will meet your expectations.
Any material downloaded or otherwise obtained through the use of the service is done at the buyer’s discretion and risk. The buyer will be solely responsible for any damage to the buyer’s computer system or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by the buyer from the Seller or through or from the service shall create any warranty not expressly stated in the terms.
